Play for Earth – Terms of Use

Welcome to Play for Earth. These Terms of Use (“Terms”) govern access to and use of the Play for Earth website, applications, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility

The Platform is intended for use by organisations and their authorised users.

Individual users must be at least 13 years old, or the minimum legal age required in their jurisdiction, to use the Platform. By accessing the Platform, you confirm that you meet this requirement and are authorised to participate in the relevant programme.

2. Accounts and access

Access to the Platform may require the creation of an account.

You agree to:

• provide accurate and up-to-date information

• use the Platform only within the scope authorised by the implementing organisation

• keep login credentials confidential
  
  

You are responsible for all activity carried out under your account.

3. Platform purpose and acceptable use

Play for Earth is a platform designed to enable, document, and verify real-world ESG and EPR-related actions through photo-based proof and engagement mechanisms.

The Platform is intended for professional and organisational use.

You agree not to:

• submit false, misleading, staged, or manipulated content

• attempt to bypass verification or misuse gamification mechanisms

• reverse-engineer, disrupt, or interfere with the Platform

• use the Platform in violation of applicable laws or regulations
  
  

Play for Earth may review, flag, or invalidate actions that do not meet programme criteria.

4. User-generated content and verification

Users may submit content such as photos, timestamps, and contextual information (“User Content”) as part of action verification.

By submitting User Content, you:

• retain ownership of your content

• grant Play for Earth a non-exclusive, royalty-free, worldwide licence to use, process, store, display, and analyse such content for:

  • verification

  • programme operation

  • aggregated reporting

  • platform improvement
    
    

You are responsible for ensuring that submitted content:

• is accurate and truthful

• does not infringe third-party rights

• complies with programme rules
  
  

Play for Earth does not guarantee that every submitted action will be validated.

5. Gamification, points, and engagement mechanisms

The Platform may use points, badges, or similar mechanisms to:

• encourage participation

• reinforce correct behaviour

• support capacity building
  
  

These mechanisms:

• have no monetary value

• do not constitute financial compensation

• may be modified, suspended, or removed at any time
  
  

Play for Earth reserves the right to adjust or revoke engagement metrics in cases of misuse or fraud.

6. Rewards and third-party offers (if applicable)

Some programmes may include physical or digital rewards provided by third-party partners.

Please note:

• Play for Earth does not manufacture, control, or guarantee third-party rewards

• availability, quality, and delivery are the responsibility of the partner

• Play for Earth is not liable for disputes related to third-party products or services
  
  

Reward availability may vary by geography and programme.

7. Data collection and privacy

Play for Earth collects limited data necessary to operate the Platform, including:

• photo-based proof

• timestamps and contextual metadata

• participation and usage data
  
  

This data is used to:

• verify actions

• provide aggregated insights to organisations

• improve platform functionality
  
  

Personal data is handled in accordance with applicable data protection laws, including GDPR where relevant.

Play for Earth:

• does not sell personal data

• limits access to authorised roles

• provides aggregated reporting by default

8. Intellectual property

All Platform technology, software, trademarks, and content (excluding User Content) are the intellectual property of Play for Earth or its licensors.

You may not copy, modify, distribute, or reuse Platform elements without prior written consent.

9. Suspension and termination

Play for Earth may suspend or terminate access to the Platform if a user:

• violates these Terms

• engages in fraudulent or misleading behaviour

• misuses verification or engagement mechanisms
  
  

Users may request account deletion in accordance with the Privacy Policy.

10. Disclaimers

The Platform is provided “as is” and “as available.”

Play for Earth does not guarantee:

• uninterrupted or error-free operation

• validation of all submitted actions

• achievement of specific ESG, EPR, or compliance outcomes
  
  

Play for Earth supports execution and verification but does not replace regulatory reporting, audits, or legal obligations.

11. Limitation of liability

To the maximum extent permitted by law, Play for Earth shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform, including:

• reliance on verification results

• inability to participate in a programme

• third-party reward issues
  
  

Total liability shall not exceed the fees paid for Platform access during the preceding 12 months.

12. Changes to these Terms

Play for Earth may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Continued use of the Platform constitutes acceptance of updated Terms.

13. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles. Any disputes shall be resolved by the competent courts of that jurisdiction.
